This Privacy Policy outlines the types of information Arnie, Inc. and its wholly owned subsidiaries Arnie Advisors, LLC and Arnie Technologies, LLC (collectively known as “Arnie”) collects and processes from and about you through our website (“Site”) and our other online facilities and services (collectively with the Site, our “Services”). Through your use of the Platform, you are consenting to the practices described in this Privacy Policy. Personal information is what allows us to identify you. We collect information you voluntarily provide when registering to use our services, filling in forms on our website, or contacting us by phone, email, chat, or social media. We also collect the information you provide, usage information, and information about your device when you use our services. Such information may include your name, email, address, SSN, and any other information you voluntarily share with us in such interactions. We also collect information about you from other sources like service providers we work with, and optional programs in which you participate, which we may combine with other information we have about you. If you are a Client, we may also collect nonpublic personal information about you and your beneficiaries, or information that is not otherwise publicly available.

Information may be used among companies that perform support services for Arnie, such as data processors, client relationship management technology, technical systems consultants, and programmers, or companies that help us market products and services to you for a number of purposes, such as:
To provide our services to you, including verifying your information or identity;
To protect your accounts/non-public information from unauthorized access or identity theft;
To process your requests such as securities purchases and sales;
To establish or maintain an account with an unaffiliated third party, such as a clearing broker-dealer providing services to you and/or Arnie, Inc.;
To service your accounts, such as by issuing checks and account statements, and preparing and filing required reports to government agencies when required for registered users;
To comply with Federal, State, and Self-Regulatory Organization requirements;
To keep you informed about financial services of interest to you;
To analyze and improve the performance of our services, as well as the experience of our site, including developing new features or services;
To detect, prevent, or address fraud and technical or security issues;
To keep you informed of other possible products and/or services that may be available to you from Arnie;
To complete surveys and/or research questionnaires related to your opinion of current or potential future services that may be offered and for internal business analysis or other business purposes;

Under Regulation S-AM, a registered investment adviser is prohibited from using eligibility information that it receives from an affiliate to make a marketing solicitation unless: (1) the potential marketing use of that information has been clearly, conspicuously and concisely disclosed to the consumer; (2) the consumer has been provided a reasonable opportunity and a simple method to opt out of receiving the marketing solicitations; and (3) the consumer has not opted out. Arnie, Inc. does not receive information regarding marketing eligibility from affiliates to make solicitations.
Regulation S-ID requires our firm to have an Identity Theft Protection Program (ITPP) that controls reasonably foreseeable risks to customers or to the safety and soundness of our firm from identity theft. We have developed an ITPP to adequately identify and detect potential red-flags to prevent and mitigate identity theft.
We do not sell personal information to any third parties. However we may share information we collect in order to provide you with the services or fulfill your requests with the following.
Affiliates: We may share your information with Arnie affiliates and subsidiaries for business, operational, promotional and marketing purposes.
Service Providers: We may share your information with compliance, recordkeeping, and custodial partners (“Service Providers”) for the purpose of providing the Services.
Select Third Parties: We may share your information with our select partners, affiliates, and other third parties that we believe may have offers of interest to you.
Legal Matters; Safety: We may access and disclose your information to respond to legal process, including subpoenas and other lawful demands for information; in connection with an investigation on matters related to public safety, as permitted by law; or otherwise as required by law. We may disclose your information to protect the security of the Services. We also may disclose your information as necessary, if we believe that there has been a violation of our Terms of Use, any other legal document or contract related to our services, or the rights of any third party.
Sale or Transfer of Business or Assets: We may sell or purchase assets during the normal course of our business. If another entity acquires us or any of our assets, information we have collected about you may be transferred to such entity. In addition, if any bankruptcy or reorganization proceeding is brought by or against us, such information may be considered an asset of ours and may be sold or transferred to third parties.
Aggregate or Anonymous Non-Personal Information: We may also share aggregate, anonymous, or de-identified non-personal information with third parties.
Other: We also may share your information as disclosed to you at the time of collection, with your consent, or at your request.
Federal privacy laws give you the right to restrict us from sharing your personal financial information. These laws balance your right to privacy with Arnie’s need to provide information for normal business purposes. You have the right to opt out of sharing certain information with affiliated and unaffiliated companies of our firm. Choosing to restrict the sharing of your personal financial information will not apply to (1) your information that we may share with companies that help promote and market our own products or products offered under a joint agreement with another company; (2) records of your transactions--such as your loan payments, credit card or debit card purchases, and checking and savings account statements--to firms that provide data processing and mailing services for our firm; (3) information about you in response to a court order; and (4) your payment history on loans and credit cards to credit bureaus. If you opt out, you limit the extent to which Arnie can provide your personal financial information to non-affiliated companies.
You may adjust your browser settings to limit certain tracking or to decline cookies, but by doing so, you may not be able to use certain features of the service or take full advantage of all of our offerings. Please refer to your device’s settings or your Internet browser’s “Help” section for more information on how to delete and/or disable your device or browser from receiving cookies or controlling your tracking preferences. California residents have specific rights regarding their information. This section provides disclosures required by the CCPA and describes how California residents may exercise their CCPA rights.
In the past 12 months, Arnie has collected the following categories of personal information: identifiers, online activity information, contact information, financial information, and demographic information.
We collected this information directly from users of our services, from our service providers, and from third parties that supplement other personal information we collect.
We collect personal information to provide, analyze, and improve the services; to personalize content on the site; to inform you of other products or services that may interest you; and to protect the services, users, and Arnie against security threats, fraud, and similar risks.
Finally, in the last 12 months, we disclosed for a business purpose the following categories of information from California consumers: identifiers, online activity information, financial information, and commercial information. We disclosed each of these categories of personal information to service providers and affiliates.
If you are a resident of California, you have the following rights:
- The right to access / the right to request. The CCPA permits you to request and obtain, up to twice per year, access to categories and specific pieces of personal information we collect about you.
- The right to delete Personal Data. You also have the right to request the deletion of personal information we collect from you.
- The right not to be discriminated against. You have the right not to be discriminated against for exercising any of your CCPA rights.
We do not “sell” personal information, as that term is defined under the CCPA. However, if you wish to opt out of the use of your personal information for interest-based advertising purposes and these potential sales as defined under CCPA law, you may do so by following the instructions provided under “Your choices and opt-outs.”
Exercising your CCPA rights. In order to exercise any of your rights under the CCPA, and if you are a California resident, you can email or call us or submit a request online via our Support Center” via the information noted below, or the section of our web page.
You may authorize another person to make CCPA requests on your behalf (an “authorized agent”). Your authorized agent will need to demonstrate that they are registered with the California Secretary of State to conduct business in California and that they have authority to act on your behalf, or that the agent holds an appropriate power of attorney. We may ask you to confirm that you authorized the agent to act for you.
Arnie will disclose and deliver the required information free of charge within 45 days of receiving your verifiable request. We may ask you to provide additional information or documentation to verify your identity. The time period to provide the required information may be extended once by an additional forty-five (45) days when reasonably necessary and with prior notice.
Arnie restricts access to nonpublic personal information about you to those individuals who need to know that information to provide products or services to you and perform their respective duties. We maintain physical, electronic, and procedural security measures to safeguard confidential client information. However, we cannot guarantee our security measures will be effective against all security threats.
In the event that the owner(s) of Arnie retire, become incapacitated, or perish unexpectedly, your information would be disclosed to an unaffiliated third party for the purposes of facilitating a business succession plan. A change in control of ownership of Arnie would require your consent, as dictated by your signed agreement with Arnie, in order to continue providing services to you.
Arnie does not target our products towards minors, nor do we knowingly collect personal identifiable information from children under the age of sixteen (16).
We maintain personal information for as long as reasonably necessary to fulfill the legitimate business purposes for which the information was collected, to meet our legal obligations, or protect or defend our legal rights.
If you decide to close your account(s) or become an inactive customer, our Privacy Policy will continue to apply to you.
Arnie reserves the right to update and/or change the terms of our Privacy Policy to reflect changes in our practices.
